Start from the main Estonia PIS and ICF
The witness pathway is a variation of the Estonia Patient Information and Consent Requirements guide.
Participant-facing information must still be in Estonian and include the EU CT number. If the person needs another participant language, that version must be provided when it is intended for use.
When an impartial witness is used
Conditional. Article 29 allows consent to be given and recorded through appropriate alternative means in the presence of at least one impartial witness when the participant is unable to write.
ICH E6(R3) also describes the impartial witness process where the participant or legal representative is unable to read. When that GCP scenario applies, the witness is present for the informed-consent discussion and attests that the information was accurately explained, apparently understood and freely accepted.
Do not use a witness simply because a participant has a disability or limited literacy if the person can still complete a valid consent process without this accommodation.
Witness independence
The witness should be independent of the trial and protected from undue influence by people involved in the study.
The witness should not be used as a substitute legal representative. Their role is to attest to the integrity of the consent process, not to make the participation decision.
The Part II consent procedure should explain why a witness may be needed, how the witness will be selected and how the consent will be documented.
Consent procedure in Estonia
Estonian law requires the participant or legal representative, before consent, to speak with a knowledgeable trial-team member who is a doctor, nurse or pharmacist and can provide a complete explanation of the trial and investigational medicinal product.
The witness procedure must preserve that discussion, adequate decision time and the participant's right to ask questions.
Where information has to be read aloud or otherwise communicated through an alternative method, document the method clearly.
Signatures
Under Article 29, when the alternative consent method uses an impartial witness, the witness signs and dates the informed-consent document.
The participant or representative should sign when capable of doing so under the applicable process. The person conducting the consent interview also signs and dates the consent.
Estonia permits legally valid digital signatures, but a digital process does not remove the need for the witness where the legal trigger for a witness remains present.
Participant copy and records
Provide the participant or legally designated representative with a copy of the consent document or record.
The site record should show why the witness procedure was used, who acted as witness, how the information was communicated and how the decision was recorded.
Avoid collecting unnecessary personal information about the witness beyond what is needed to document the consent process.
Other population rules still apply
If the participant is a minor, apply the Estonia minor consent rules in addition to the witness process.
If the participant lacks capacity, apply the Estonia limited-capacity and legal representative rules.
A witness cannot cure an otherwise invalid consent pathway.
QC before submission
Check that:
- the trigger for the witness is defined
- witness independence is protected
- the procedure explains selection and role
- Estonian participant information remains complete
- the EU CT number appears on the material
- signature blocks cover participant or representative, interviewer and witness as applicable
- the participant receives a copy
- the witness is not misdescribed as the legal decision-maker
